1. Acceptance of Terms & Conditions
The eProffer web site (“Site”) is owned and operated by Levansys Ltd (“Levansys”). Levansys is a company registered in England, company no. 7220123, registered office: Water Hall, Wheelers Lane, Great Ashfield, Suffolk, IP31 3HP. The Site provides online classified listings and advertising, plus to links to third party web sites via the Site.
Listed below are the Terms & Conditions (“Terms”) for the Site. The Terms govern your use of and behavior on the Site. You are asked to read through the Terms thoroughly. By using the Site you agree to be bound by the Terms. If you do not agree with the Terms please exit and do not use the Site.
Levansys reserve the right to amend the Terms from time to time. It is incumbent upon you to check the Terms periodically. Your continued use of the Site after amendments have been published shall be deemed to be your agreement to the amended Terms. The most up to date version of the Terms can be found at Terms.
2. Your Conduct
By using the Site you, or anyone using your account, agree not to transmit via posting, email or otherwise material that:
- is defamatory, threatening, obscene, indecent, pornographic, abusive, seditious, offensive, pornographic, abusive, menacing, discriminatory, bigoted, blasphemous, scandalous, inflammatory, racially offensive, harmful, in breach of confidence and/or privacy, cause annoyance or inconvenience, otherwise objectionable ; or
- is technically harmful (including but not limited to viruses, logic bombs, trojan horses, worms, harmful components, corrupted/harmful data, destructive code); or
- promotes or advertises any illegal items or services, is fraudulent, advertises counterfeit or stolen items for sale, you haven’t acquired consent/approval or license for, infringes the rights of any third party, encourages conduct that constitutes any criminal offense, gives rise to civil liability or otherwise violates laws and/or regulation; or
- constitutes misuse of the Site (including but not limited to hacking); or
- infringes on trademarks, patents, copyrights or other proprietary rights; or
- contains personal information about another member/user without their permission; or
- redirects to, promotes or advertises other sales, auctions or classified advertising/listings sites .
You also agree not to transmit, modify, publish, display, copy, sell, transfer, reproduce, distribute, or exploit in any way, in whole or part, any of the content of the Site without our written consent.
Levansys will co-operate with any law enforcement authorities and/or court order requesting disclosure of the location and identity of anyone in breach of the Terms.
All posted content on the Site is the sole responsibility of the member, or person using that account, who posted the content. Levansys will not be held responsible or liable for any posted content in any way.
3. The Site
Levansys provide this Site to you and you understand and acknowledge that you use the site at your own risk. You acknowledge and agree that Levansys reserves the right to alter, suspend or discontinue the Site and may do this at any time without notice and any liability to you. You also acknowledge and agree that Levansys may temporarily or permanently delete content provided by you. Levansys has no responsibility or liability for inaccuracy, deletion, failure to present correctly, failure to store or timeliness of content.
4. No Spam Policy
You agree not use the Site to for spamming purposes. Spamming is not limited to but does include:
- sending messages to other members that promote alternative web sites or publications; or
- sending unsolicited messages to other members which may be deemed to be libelous, threatening, obscene, offensive, harassment or provoke complaint from that member; or
- manually collect personal information including but not limited to email addresses; or
- use automated devices, robots or spiders to collect personal information including but not limited to email addresses.
5. Registration
In order to submit/post classified adverts or contact a vendor on the Site you will need to register. In order to register on the Site you need to be at least 14 years of age. During registration Levansys collects your email address in order to send you your password and verify your ownership of the email address you provide, for other members to contact you in response to any classified adverts that you place on the Site and for Levansys to contact you periodically. We also collect your name, town, and county and post code.
Once you have verified your email address and logged in you can access your My Control Panel where you may change your details, submit classified advertsand edit your classified adverts.
6. Password
Initially you will be supplied with a password by Levansys. You may change this password after your first log in. Your password is solely your responsibility and it is incumbent on you to keep your password confidential and not disclose it to any other persons. You agree to be responsible for all uses of your login/control panel whether authorized or unauthorized by you. You agree to notify us immediately of any breach of security or unauthorised use of your account.
7. Pricing & Payments
From time to time Levansys offer free listings to users, you will be advised of free offers as and when they are available. In all other cases listings require payment prior to posting. Levansys uses PayPal to collect all payments. Levansys DO NOT hold any of your credit card information. Details of current pricing for various listing types can be found at: Prices
8. Posting/Submitting Content
You may post content to the Site that is owned by you which you are fully responsible for and to the consequences of. By posting content to the Site you agree to grant Levansys the right to publish, distribute, edit or copy and otherwise use in any medium and for any purpose content that you have placed on the Site. Furthermore you represent and warrant that you have the right to grant Levansys such rights. You also agree that Levansys may at any time and for any reason edit, delete or refuse to publish any content with or without notice to you.
9. Third Party Advertisements, Goods & Services
The Site may contain advertising for the goods and services of third parties. Levansys accept no liability or responsibility for the accuracy of third party material. All third party content is published by Levansys in good faith. By purchasing goods or using the services of third party advertisers you will be governed by the policies and representation made by the third parties offering these good and/or services. Levansys will have no responsibility or liability whatsoever to any user of the Site in respect of third party material/content.
The Site also contains links to other web sites that Levansys has no control over. You acknowledge and agree that Levansys shall not be liable whatsoever for the content, or for any damages or loss arising from your use of these linked web sites.
10. Exclusion of Liability
Most of the content on the Site is posted/submitted, and therefore published, by individual users of the Site. You acknowledge that Levansys makes no warranties or representations as to its accuracy, reliability, truthfulness or the fitness for purpose of such content. Content on the site is for information purposes only, and you should not rely upon it in any way or for any purpose. Users are advised to check all advert details carefully and if in doubt seek legal advice prior to entering into any agreement or contract.
Levansys shall not be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, loss of data or loss of business, revenues or profits, whether in an action of contract, negligence or otherwise whatsoever resulting from use of, performance of or inability to use the Site.
You acknowledge that pages contained within the site may contain typographical errors, technical errors and/or out of date information. Levansys accepts no responsibility or liability for keeping or failing to keep these pages up to date.
You acknowledge that although Levansys makes every effort to ensure the Site is available twenty four hours a day, seven days a week we are not liable in any way if the Site is unavailable at any time, whether this is due to system failure, repair, maintenance or interruption of service beyond our control.
11. Copyright
All content contained within the pages of the Site (including but not limited to literary and artistic work) is owned or licensed by Levansys unless otherwise stated.
12. Indemnification
You agree to indemnify Levansys, or anyone related to Levansys in any way against any claim or demand (including solicitor’s fees), due to any third party claims, actions or allegations due to or arising from your submissions, postings or other use of or connection with/to the Site, your violation of these Terms or any other violation of any other person or parties rights or as a result of any harassing, obscene, threatening, offensive or libelous content within any of your submissions, postings or other use of the Site.
13. Privacy Policy
All personally identifiable information (“Data”) that Levansys collect, store and use on the Site will be processed in accordance with this Privacy Policy and the Data Protection Act. We may amend this policy from time to time. It is incumbent upon you to check the Privacy Policy periodically. Your continued use of the Site after amendments have been published shall be deemed to be your agreement to the amended Privacy Policy.
Levansys collect Data from you during the registration process. This process requires you to enter a valid email address, your name and your town, county and post code of your residence. This data is stored by Levansys for use within the Site. We may also, via our server log files, receive your IP address and cookie information.
The Data that you supply us with may be used to administer, improve and develop the Site. We make every effort to protect your data from being passed on to third parties except:
- with your consent (you agree to allow us to forward your name and email address when you are using forms on the Site to contact other users in response to their adverts); or
- we discover that you have violated the Privacy Policy; or
- the site is purchased or taken over by a third party; or
- it is necessary for us to do so for legal or law enforcement processes.
From time to time Levansys may place cookies which contain small amounts of information on your computer. These cookies will help us monitor web site traffic, improve the Site and will help to enhance your experience on the Site by tailoring the Site to you and your location.
